2. Eligibility & Account Responsibilities

  • B2B and Commercial Focus: Our Services are primarily intended for international automotive dealers, corporate fleet operators, government procurement agencies, and registered individual importers.

  • Accuracy of Information: You agree to provide current, complete, and accurate purchase and account information for all transactions. You are responsible for ensuring your contact details and destination port information are strictly accurate.

  • Account Security: If you are provided with a dedicated dealer portal account, you are responsible for maintaining the confidentiality of your login credentials and all activities occurring under your account.

3. Vehicle Information, Specifications & Availability

  • Vehicle Listings: While we strive to ensure that all vehicle details, specifications, and availability displayed on our website are accurate, errors or omissions may occur.

  • Availability: All vehicles are subject to prior sale. Factory allocations and inventory levels change rapidly. A vehicle is not reserved until a Proforma Invoice is signed and the required deposit is cleared.

  • Modifications: Manufacturers reserve the right to alter vehicle specifications, features, and trims without prior notice. EVOVED will communicate any significant factory-level changes before finalizing your order.

4. Pricing, Quotations & Payment Terms

  • Quotations: All official quotations are provided in US Dollars (USD) or Euros (EUR) and are valid for seven (7) calendar days due to fluctuating currency exchange and global ocean freight rates.

  • Pricing Transparency: Our quotations explicitly itemize the vehicle cost, inspection fees, Chinese export documentation, port handling, and ocean freight (if utilizing CIF terms).

  • Payment Schedule: Unless a separate commercial agreement is executed, standard payment terms dictate a 30% initial deposit via Telegraphic Transfer (T/T) to secure the order, with the remaining 70% balance due prior to the vehicle loading onto the export vessel.

  • Letters of Credit: For high-volume fleet orders, irrevocable Letters of Credit (L/C) at sight from approved top-tier international banks may be accepted upon prior agreement.

  • Taxes and Duties: Prices quoted do not include import duties, value-added taxes (VAT), or local registration fees applicable in your destination country.

5. Vehicle Inspection & Quality Guarantee

  • Pre-Shipment Inspection: EVOVED guarantees that every exported vehicle undergoes a rigorous, independent third-party physical and mechanical inspection prior to export.

  • 100% Roadworthy Guarantee: We guarantee that vehicles meet our "100% Roadworthy" standard before leaving our facilities. Detailed inspection reports, including high-resolution media, are provided to the buyer.

  • Inspection Failure: If a reserved vehicle fails the third-party inspection, EVOVED will immediately source an identical replacement. If a suitable replacement cannot be sourced, the buyer's deposit will be fully refunded.

6. Shipping, Logistics & Risk of Loss

  • Shipping Terms: EVOVED generally operates under CIF (Cost, Insurance, and Freight) or FOB (Free On Board) Incoterms 2020, as specified in your purchase agreement.

  • Transit Insurance: For CIF shipments, EVOVED secures comprehensive marine cargo insurance on behalf of the buyer, covering total loss and major damage from the port of loading to the destination port.

  • Transfer of Title: Title and ownership of the vehicle(s) transfer to the buyer only after EVOVED has received full and final payment of the invoice.

  • Port Delays: EVOVED is not liable for shipping delays caused by port congestion, vessel rescheduling, customs holds, or global supply chain disruptions outside of our direct control.

7. Import Regulations & Customs Clearance

  • Buyer Responsibility: It is exclusively the buyer’s responsibility to verify that the purchased vehicle(s) comply with all local import laws, age restrictions, emissions standards, and safety homologation requirements of the destination country.

  • Clearance Costs: The buyer is solely responsible for all destination port charges, customs brokerage fees, import tariffs, and local registration taxes.

  • Documentation: EVOVED will provide all necessary original export documentation (Bill of Lading, Commercial Invoice, Certificate of Origin, Export License). We are not liable for clearance delays resulting from the buyer's failure to engage a competent local customs broker.

8. Warranty & After-Sales Support

  • Standard Warranty: EVOVED provides a standard 1-year exporter’s warranty covering major powertrain components on new vehicles, unless otherwise stated in writing.

  • Warranty Claims: Claims must be submitted with a certified mechanic's diagnostic report. EVOVED's liability under this warranty is strictly limited to the provision of replacement parts, shipped to the buyer. We do not cover local labor costs.

  • Parts Supply: EVOVED offers lifetime access to our parts division for OEM replacement parts, which the buyer may purchase at competitive rates.

9. Cancellations & Refund Policy

  • Buyer Remorse: Once a Proforma Invoice is signed and the 30% deposit is paid, the deposit becomes non-refundable if the buyer cancels the order for reasons unrelated to EVOVED's performance. This covers the administrative and allocation costs incurred.

  • EVOVED Cancellation: We reserve the right to cancel any order if the buyer fails to remit the final balance within the agreed timeframe, or if the manufacturer permanently ceases production of the requested model. In the latter case, a full refund will be issued.

10. Intellectual Property

All content on the EVOVED website, including but not limited to text, graphics, logos, images, digital downloads, and software, is the property of EVOVED AUTOMOBILE Co., Ltd. or its content suppliers and is protected by international copyright and trademark laws. You may not extract or utilize any portion of our content for commercial purposes without express written consent.

11. Limitation of Liability

To the maximum extent permitted by applicable law, EVOVED AUTOMOBILE Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of (or inability to access or use) the Services;

  2. Any conduct or content of any third party on the Services;

  3. Any shipping, transit, or customs delays;

  4. Any failure of the vehicle to meet local destination regulatory requirements.

12. Force Majeure

EVOVED shall not be held liable for any failure or delay in fulfilling our obligations under these Terms if such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, global pandemics, strikes, maritime disasters, or severe government export/import restrictions.

13. Governing Law & Dispute Resolution

  • Jurisdiction: These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the People's Republic of China.

  • Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by arbitration administered by the Shanghai International Economic and Trade Arbitration Commission (SHIAC) in accordance with its rules.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
